I don't have alot of experience with Palm products, but I did purchase a brand-new Palm III at an estate sale, still shrink-wrapped with all the docs, advertisements, and coupons for now defunct software. The battery compartment had the plastic tab to be pulled before first use.

The first time I turned the unit on, the screen was so dim that it was almost un-readable. NO amount of back-light or contrast tweaking would make it better.

My point is, that this screen went south just sitting in the box, in its original packaging for 10 years.

IF you have the equivalent of a Better Business Bureau, or some docs from Palms tracking product defects over time, you could probably present these as a viable history that screen failures are part and parcel of Palm PDA.

Obviously you didn't walk out of the store with a cracked screen, so any docs you can introduce(in the form of official documention or consumer complaints against Palm) then the magistrate may give you the benefit of doubt.

IF you just show up in court with nothing but your word against theirs, it is a waste.
